Starting from June 1st, Monaco will authorize teleworking for Italian cross-border workers who have jobs suitable for remote work. This is a significant development as an addendum to the General Convention on Social Security between the Principality of Monaco and the Italian Republic, ratified by both countries, will come into effect on June 1st, 2024 [https://montecarloin.net/2021/05/telelavoro-accordo-tra-principato-e-repubblica-italiana/].
It took three years for the agreement to be ratified, with the government of Prince Monaco, led by Minister of State Pierre Dartout, and the Italian Minister of Labor at the time, Andrea Orlando, signing it after five years of negotiations in 2021.
Under this agreement, the definition of teleworking is established and it states that Italian residents who telework can be subject to Monegasque social legislation for the duration of their activity. This expansion of teleworking access to a new group of employees is a significant step forward for both Monaco and Italy. It will effectively address the challenges posed by the consequences of the Principality’s economic development, particularly its limited territory, while facilitating Italian employees’ access to work.
Practically, similar to cross-border workers residing in France, teleworking must be formalized through an employment contract or a modification to the existing contract. Teleworking employees will be required to be present in the office for at least one-third of their working hours to maintain necessary teamwork connections.
